Resolving disputes out of court
When many people think of legal disputes, they think of expensive, high-pressured days in court. However, the modern way of tackling disputes is now very different. In 1998, the Wolfe reforms were introduced. These reforms encouraged the use of Alternate Dispute Resolution, which includes mediation and arbitration. Both these methods are designed to be less formal, cheaper, quicker and more efficient. In mediation, the parties are encouraged to come to a compromise and agree on a settlement. In arbitration, a third party acts as a judge and comes to a decision on a point of law. In both cases, the proceedings must be entered into willingly
